The same institutions collecting €6 billion in privacy penalties want to read your WhatsApp chats
Here's a number worth remembering: €5.88 billion. That's how much the European Union has extracted from technology companies since 2018 for violating citizens' privacy rights. The message was unmistakable—Brussels would defend digital privacy with unprecedented fury.
Here's another number: 19 out of 27. That's how many EU member states now back legislation requiring every private message, photo, and video to be scanned before encryption. The same Union that fined Meta €1.2 billion for privacy violations wants mandatory access to communications that GDPR supposedly protects.
This isn't bureaucratic confusion. It's institutional strategy wearing the mask of contradiction.
The billion-euro privacy champion
European regulators built their global reputation through privacy enforcement that bordered on evangelical. Ireland alone imposed €3.5 billion in fines—more than four times any other jurisdiction. Dutch authorities hit Uber with €290 million for transferring driver data. LinkedIn received €310 million for behavioural profiling.
Each penalty carried stern sermons about European values. "Personal data is not a commodity," officials proclaimed whilst wielding the General Data Protection Regulation like a regulatory weapon. GDPR became Europe's most successful export, copied across continents as the supposed gold standard for digital rights.
Corporate boardrooms took notice. Chief executives who previously ignored privacy lawyers suddenly attended data protection briefings. The threat of fines reaching 4% of global revenue concentrated minds wonderfully. DLA Piper's annual surveys document this enforcement explosion with meticulous precision.
Europe had positioned itself as privacy's global defender, extracting billions from American tech giants whilst lecturing the world about digital rights. The performance was convincing because the consequences were real.
Mass surveillance in democracy's clothing
Chat Control takes a different approach to the same data GDPR allegedly protects. Instead of fining companies for accessing private communications, the EU wants to mandate such access for every citizen.
The mechanism is elegant in its invasiveness. "Client-side scanning" embeds detection software directly into phones and computers, analysing content before encryption occurs. Former German MEP Patrick Breyer captures the absurdity: "A bit like if the Post Office came to read all your letters in your living room before you put them in the envelope."
Denmark's EU presidency has made this surveillance regime its priority, targeting a Council vote by October 14th. The justification remains constant: protecting children from sexual abuse material. The technical reality tells a different story.
Actual criminals will simply switch to platforms that ignore EU law—as they already do. The system will primarily flag innocent users whose family photographs trigger false positives. Switzerland's voluntary trials show 80% false-positive rates, turning parents into suspects for taking bath-time photos.
Technical effectiveness may not be the point.
When blocking minorities aren't enough
Chat Control's persistence despite repeated rejections exposes how EU institutions outlast democratic opposition. When governments formed a "blocking minority" to stop the proposal in December 2024, Denmark simply reintroduced it with cosmetic changes by July 2025.
This institutional stamina contrasts sharply with democratic exhaustion. Privacy advocates must mobilise opposition repeatedly whilst EU institutions need only one successful vote for permanent surveillance infrastructure.
Germany's resistance proves crucial but fragile. The country that experienced both Nazi surveillance and Stasi monitoring maintains deep cultural aversion to state communications monitoring. Justice Minister Marco Buschmann declared Chat Control "has no place in a constitutional state."
Yet opposition erodes through diplomatic pressure. France abandoned resistance after initially joining the blocking minority. Several other governments shifted from opposition to "undecided" status, despite the 2025 proposal being "even more extreme" than rejected 2024 versions, according to Breyer.
The blocking minority celebrated temporary victory in December. By July, that victory looked increasingly pyrrhic.
Institutional power over democratic will
The GDPR-Chat Control paradox reveals how EU institutions deploy contradictory principles depending on their target. Against US technology companies, privacy becomes a fundamental right requiring billion-euro enforcement. For internal surveillance capabilities, privacy becomes a "national security" matter requiring institutional flexibility.
This strategic positioning serves dual purposes. GDPR projects European values globally whilst constraining American corporate dominance. Chat Control builds domestic surveillance infrastructure whilst maintaining democratic appearances through child protection rhetoric.
The European Commission's own behaviour confirms this interpretation. When Chat Control faced public resistance, the Commission violated its own privacy rules by using illegal micro-targeted advertising campaigns to build support. The European Data Protection Supervisor subsequently ruled these targeted campaigns breached the very GDPR the Commission enforces against others.
The irony is breathtaking: privacy police caught violating privacy law to promote anti-privacy legislation.
The real purpose behind 'child protection'
Child sexual abuse material provides perfect political cover because opposing such measures appears morally indefensible. Yet Chat Control's design suggests broader surveillance objectives.
The system would scan all communications, not just suspicious traffic. Age verification requirements would eliminate online anonymity. Network blocking would enable platform censorship. These capabilities exceed child protection requirements but align perfectly with comprehensive surveillance infrastructure.
Once scanning systems exist for child abuse content, expanding to terrorism, organised crime, or political dissent requires only software updates. The Commission's ProtectEU strategy, announced June 2025, already seeks "decryption powers by 2030" across all investigation categories.

Democratic accountability in the surveillance age
Chat Control exposes a fundamental question about EU legitimacy: can institutions exempting themselves from their own rules claim democratic authority?
European regulators fine companies billions for collecting data they argue violates citizen rights. European policymakers simultaneously propose collecting identical data through mandatory surveillance. The contradiction reveals institutional priorities with uncomfortable clarity.
Privacy protection serves external projection whilst surveillance capability serves internal control. Both advance EU institutional power—regulatory dominance over global technology markets and monitoring capability over European citizens.
This dual approach tests democratic tolerance. Citizens watching governments collect €6 billion in privacy fines might reasonably expect those governments to respect privacy principles themselves.
October's vote determines whether EU institutions can successfully maintain different standards for themselves than they impose on others. The precedent will shape European surveillance policy for decades.
As Breyer warns: "Europeans need to understand that they will be cut off from using commonplace secure messengers if this bill is implemented—that means losing touch with your friends and colleagues around the world."
The choice isn't between security and privacy. It's between institutional power and democratic accountability. Brussels has already shown which side it prefers.
